We will bill your credit card in advance on a periodic basis in accordance with the terms set out in the Service. All fees are non-refundable except as required by law. You are responsible for all charges incurred under your account, whether made by you or another person using your account. If you cancel the Service before the end of your current paid up period, your cancellation will take effect immediately, and you will not be entitled to any refund of fees already paid. Upon subscribing to our paid Services, you are obligated to complete the full term of the subscription. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.

Unless you notify MyFO before the end of the applicable subscription period that you want to cancel the Service, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for the Service (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Subscriptions can be cancelled at any time by contacting customer support at support@myfo.com.

The Services provided by MyFO, including but not limited to financial tracking, AI features and wealth management features, are intended to assist users in managing their financial information and planning their financial strategy. All information, content, and material available on or through the Services is for informational purposes only and is not intended to serve as a substitute for the consultation, advice or guidance of a qualified financial, legal, investment or other advisor. MyFO is not a registered investment adviser, broker/dealer, financial analyst, financial bank, securities broker, or financial planner. Any use of the Services, reliance upon any materials or information provided by MyFO, and any decisions made based upon such use or reliance, are at your sole discretion and risk. You agree to bear all risk associated with, and agree to release and hold harmless MyFO, its officers, directors, employees, and agents from any and all liability for your use of the Services, including but not limited to decisions that you may make based on the information made available through the Services.

However, by uploading or sharing User Content, you grant us a license to use, copy, display, and distribute your User Content in order to provide the Services and in accordance with our Privacy Policy.

Please note that if your account is cancelled, we do not have an obligation to delete or return to you any content you have posted to the Services.

To the maximum extent permitted by law, you concur that neither First Democracy Technology nor its current or future partners, vendors, or representatives shall be accountable to you or any third party for exemplary, incidental, indirect, or related damages, including lost profits, breaches of privacy, data loss, or failures of duty, whether they be of good faith, professional effort, or absence of negligence. This stands even if First Democracy Technology is informed of potential damages and regardless of the cause, including negligence, strict liability, product liability, or deception.

Should First Democracy Technology be deemed liable for any reason, First Democracy Technology's total obligation to you or any third party will not exceed the larger of: (i) the amount you've paid to First Democracy Technology within the past twelve (12) months leading up to the event causing liability; or (ii) $100 USD. Any legal claim you wish to bring against First Democracy Technology must be initiated within a year of the incident; if not, such claim will be considered forever waived. The disclaimers and liability restrictions in these terms shall remain in effect even if a specified remedy does not fulfill its intended function.

By using our Services, you agree that we can collect and use anonymized, non-identifiable technical and related information, as well as anonymized, non-identifiable investment statistics, including but not limited to details about asset classes, allocations, and other investment activities, along with technical information about your device, system and application software, and peripherals, as well as your interactions with the Services. 26. We shall not be liable for any failure to perform our obligations hereunder where such failure results from any cause beyond our reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation.

No consent or waiver by either party to, or of any breach or default by, the other party in its performance of its obligations under this agreement will be deemed or construed to be a consent to, or a waiver of, a continuing breach or default or any other breach or default of those or any other obligations of that party. No consent or waiver will be effective unless in writing.

28. If any provision of these terms and conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.

29. These terms and conditions are governed by the laws of British Columbia and the laws of Canada applicable therein, excluding any conflict of laws which would lead to the application of any other laws.
